Inside the Courtroom: How Defense Attorney Kenneth Rosenfeld Overturned a “No Bail” Ruling

“No bail” rulings can be challenging for defense attorneys to deal with, because it increases the urgency of their case, requiring them to act quickly to get the decision reversed. Acting quickly is paramount so that defendants are not separated from their families for extended periods of time. “No bail” rulings can be particularly troublesome when defendants are deemed “flight risks,”  which results in some of the most stringent restrictions on a defendant’s movement. Attorneys must take extra care to navigate the complexities of a situation when foreign nationals are deemed flight risks while facing a trial in the United States.

Attorney Kenneth Rosenfeld is one California criminal defense attorney who has successfully navigated the challenges of a “no bail” ruling in which his client, Jesus Cortes-Padilla, was deemed a flight risk in 2024. The court based its assessment on several conversations Cortes-Padilla had with his wife in which they discussed selling his assets and relocating elsewhere after his release. The fact that Cortes-Padilla was a Mexican citizen also played a role in the court’s decision to deem him a flight risk.

Kenneth Rosenfeld’s strategy for getting the “no bail” ruling overturned challenged the court’s notions that were based on these phone conversations. Rosenfeld successfully argued that the conversations had either been taken out of context or translated poorly since Cortes-Padilla and his wife had spoken in Spanish. He also argued that Cortes-Padilla had not attempted to flee before the arrest. He brought up the fact that the Cortes-Padilla family had a modest standard of living, undermining the court’s ideas about his motivations for selling assets. 

As a result of Kenneth Rosenfeld’s contentions, the court was persuaded to reassess the evidence and concluded that their initial interpretation of the evidence was incorrect, driven by conversations that were taken out of context and ideas that were lost in translation. Cortes-Padilla was released shortly thereafter and allowed to reunite with his family. 

The important lessons from this case include the importance of high-quality translation in cases involving non-native English speakers, the ways that nationality and ethnicity can lead to unforeseen challenges in the legal system, and the importance of taking evidence in its proper context. Although Kenneth Rosenfeld experienced some challenges related to his client’s status as a foreign national, he was still able to make a persuasive argument against a “no bail” ruling by examining the evidence in its proper context and acknowledging the factors that may have led to a skewed interpretation of it.

While language and national barriers are still very real challenges in legal cases that involve citizens of other countries, defense attorneys can benefit from knowing what tools are at their disposal in cases such as these. By insisting on the importance of good translation during cases that involve a language other than English being spoken, attorneys can ensure fairer assessments of their clients. 

Furthermore, it is an attorney’s job to ensure that all of the evidence is being taken in its proper context. Courts are not immune to making erroneous decisions, and attorneys are the only people with the power to defend their clients when a wrong decision is made. Attorneys must do everything in their power to advocate for their clients, especially when the odds are stacked against them because they are not American citizens.
