Is CBD oil legal in your state?

Just as researchers are discovering all the potential benefits and uses of cannabidiol (CBD), the legal system is scrambling to keep up with consumers’ newfound demand and knowledge about the product. Despite CBD’s health benefits and lack of intoxicating effects, the law still can’t tell the difference between CBD and marijuana in certain contexts. And if you live in certain states, you may feel even more confused about whether or not it’s legal to purchase CBD products.

Just as researchers are discovering all the potential benefits and uses of cannabidiol (CBD), the legal system is scrambling to keep up with consumers’ newfound demand and knowledge about the product. Despite CBD’s health benefits and lack of intoxicating effects, the law still can’t tell the difference between CBD and marijuana in certain contexts. And if you live in certain states, you may feel even more confused about whether or not it’s legal to purchase CBD products.

After the 2018 Farm Bill was passed, it became nationally legal to buy and sell hemp and hemp-derived products, but only if those products contained no more than 0.3% THC, which is the psychoactive component that gives marijuana users a high. In theory, this should make it legal to sell CBD oil derived from hemp, but if CBD oil is derived from a plant that fits federal law’s definition of “marijuana,” it is still considered illegal.

However, this law is very rarely enforced strictly at a federal level, and may even be changed as lawmakers debate the technicalities of CBD, hemp, and marijuana. On a statewide level, the legality of CBD oil looks a little different. In states where marijuana is legal, both for recreational and medicinal purposes, it is likely easier to obtain CBD oil with no issues. In states where only medical marijuana is legal, the rules for obtaining CBD oil may vary, so it’s best to do some research first. There are even other states such as Alabama and Georgia that generally do not allow cannabis, but will allow CBD oil under specific conditions.

Hopefully, lawmakers can make it easier to understand the legality of CBD oil as time goes by, so that the people who can benefit most from CBD’s positive effects can have easier access to it.
